Bill Summary

This bill provides that, except as allowed by zoning ordinance adopted pursuant to law, an application for development proposing a large warehouse is to provide for an adequate number of onsite parking spaces to accommodate tractor trailers servicing that large warehouse as a condition of preliminary site plan approval, such that tractor trailers servicing the warehouse do not contribute to an overflow of tractor trailer parking onto other local properties or rights-of-way between the hours of 10:00 p.m. and 6:00 a.m. The bill further provides that a municipality may enact a zoning ordinance that allows the number of onsite parking spaces required for overnight tractor trailer parking, pursuant to the bill, may be reduced, and that an application for development for a large warehouse that contributes to an overflow of tractor trailer parking onto other local properties or rights-of-way may be approved, as allowed by the zoning ordinance.

AI Summary

This bill requires that any application for development proposing a "large warehouse," defined as a facility of at least 100,000 square feet primarily used for storing, loading, and unloading goods, must include an adequate number of onsite parking spaces for tractor trailers. This is a condition for preliminary site plan approval, intended to prevent tractor trailers from parking on local properties or rights-of-way between 10:00 p.m. and 6:00 a.m. However, municipalities can adopt zoning ordinances that allow for a reduction in the required number of onsite parking spaces for overnight tractor trailer parking, and can approve applications for large warehouses that might cause parking overflow if they comply with these local zoning ordinances.
