This bill requires electric utilities to protect residential and retail electricity customers from costs associated with building and operating data centers, which are defined as facilities with a peak annual electricity demand of 100 megawatts or greater used primarily for processing, storing, retrieving, or transmitting data. Specifically, any contract between an electric utility and a data center for electricity service, entered into on or after the bill's effective date, must include terms and conditions to safeguard other customers. These terms must ensure that data centers cover their own incremental costs, allow for contract lengths longer than standard service tariffs, include protections for other customers if the data center defaults on its contract, and provide safeguards if the data center contract is terminated. The Public Service Commission (commission) will be responsible for ensuring compliance with these requirements.
