This bill establishes immunity from public and private nuisance claims for racing facilities, defining "racing facility" as an area where competitive vehicle and motorsport races occur, including associated grounds and buildings, and "racing operations" as the lawful and inherent activities of such facilities, such as practice, racing events, vehicle maintenance, and the use of infrastructure, while excluding certain off-road or casual vehicle use. The bill specifies that property owners cannot bring nuisance claims against a racing facility if they purchased their property or built new construction within a defined radius of the facility (five miles in rural counties with populations under 50,000, and three miles elsewhere) after the facility was built, and that a racing facility cannot be considered a nuisance solely due to changed conditions related to its operations if it has been operating for at least one year, unless there is a material change to its historic racing operations. This immunity will take effect on July 1, 2026, and apply to all nuisance lawsuits filed on or after that date.
