This bill amends existing law in Kansas to allow cities and counties to conduct interior inspections of residential properties without the occupant's consent under specific circumstances, primarily when a city or county has a residential property licensing ordinance that requires such inspections. Previously, occupant consent was generally required for these periodic interior inspections to check for code violations. However, this bill now permits inspections without consent if they are conducted under an administrative warrant, which is a court order authorizing an inspection for regulatory purposes, or if there is probable cause to believe there is an imminent danger to health and safety on the property, provided reasonable notice is given to the occupant. These new provisions do not affect inspections of mixed-use residential and commercial properties, nor do they prevent cities or counties from conducting inspections related to building permits like plan reviews, construction inspections, or final occupancy inspections. The bill also repeals the existing law it amends, meaning the new provisions will replace the old ones.
