This bill establishes a new chapter in Hawaii Revised Statutes to create a "buffer zone" around state highways, defined as a one-hundred-foot area from the highway's right-of-way, which is the land owned by the state for the highway. The bill prohibits anyone from setting up, placing, constructing, or maintaining an "encampment," meaning a tent, makeshift shelter, or any temporary structure used for living, within this buffer zone. Violators can be immediately removed and may face a fine of up to $200, and could also be charged with trespassing or other offenses. Law enforcement is required to provide information about housing and homelessness assistance to those displaced and to take custody of their personal belongings for safekeeping and return.
