Bill Summary
AN ACT Relating to remote marriage solemnization of deployed persons.
AI Summary
This bill allows members of the "Armed Forces of the United States," which includes regular and reserve components of all branches and the National Guard, to get married remotely if they are unable to be present in person due to active service. Specifically, if a service member cannot apply for a marriage license in person, the county clerk cannot deny it solely for their absence, and the service member can sign the application electronically. Furthermore, a marriage can be solemnized without the service member's physical presence if a "judicial officer" (a judge or justice) performs the ceremony, the service member appears remotely using "communication technology" (any electronic device allowing simultaneous sight and sound communication between people not physically together), and all other marriage requirements are met. The judicial officer also has the discretion to waive the fee for such remote marriages.
