The bill clarifies that the DEQ must first consider using its existing staff before hiring additional help or outside contractors, and it outlines a process for regulated entities to request these agreements, including providing justification and demonstrating project readiness. The DEQ must respond to these requests within 45 business days and make information about these agreements public, with certain confidential business information redacted. Importantly, the DEQ cannot waive its own authority or obligations, nor can it alter the requirements for regulated entities, through these agreements. The bill also specifies that payments received under these agreements will not exceed the cost of the services provided and will be continuously appropriated for the purposes outlined in the agreements. Finally, the bill sets an operative date for these changes and an effective date for the bill itself.
