This bill amends existing law to create a new exemption for certain renewable energy facilities from the requirement of obtaining a site certificate, which is a permit needed for the construction or expansion of energy facilities. Specifically, facilities that produce power exclusively from solar photovoltaic or thermal energy, wind energy, geothermal energy, or marine energy will be exempt if the developer submits a land use application to the local government by December 31, 2028, and receives approval, and also provides notification to the local government and the Energy Facility Siting Council confirming that construction has begun to qualify for federal tax credits under specific sections of the Internal Revenue Code (IRC). The facility must also be placed in service by December 31, 2030, or by a later date allowed by the U.S. Department of the Treasury or Internal Revenue Service for continued qualification for these tax credits. The bill also includes provisions for the effective date of this new law.
