This bill allows an "operator," defined as a person or entity offering or providing a sport, fitness, or recreational activity or the place to do so, to require participants aged 18 and older, or their parents or guardians for those under 18, to sign a written release waiving claims for "ordinary negligence," which means simple carelessness, for injuries sustained during the activity, provided the release clearly discloses the risks. However, this waiver cannot apply to claims involving more serious misconduct like gross negligence or intentional acts, injuries occurring outside the direct activity (such as in parking lots or lodges), issues with equipment design or maintenance, violations of safety rules, negligent hiring or supervision of staff, failure to warn of non-inherent hazards, or the operation of vehicles unless the vehicle is part of the activity itself. The bill also declares an emergency, meaning it will take effect immediately upon passage.
