This bill restores local control and regulatory authority to counties and municipalities over certified microgrid districts and certified high impact data centers, which are projects that have been officially recognized by the Secretary of the Department of Commerce. The bill removes previous language that prevented local governments from enacting or enforcing ordinances that would limit the creation or operation of these certified projects, and also removes restrictions on local zoning, building permits, and other regulations. However, the bill clarifies that owners and operators of these certified projects will still be required to pay various local taxes, fees, and utility charges, and must adhere to the State Building Code. The Department of Commerce will continue to assist in the development and operation of these projects, and state departments like Environmental Protection and Transportation may also provide support for necessary infrastructure improvements.
