This bill revises public notice requirements for new sand, gravel, and construction aggregate mines in South Dakota, differentiating requirements based on the size of the operation. For smaller operations affecting ten acres or less, or extracting less than twenty-five thousand tons of material annually, operators must publish notice once in a local newspaper at least fourteen days before mining begins, and send all required information, including a map, to specific state departments, local conservation districts, nearby residents, county commissioners, nearby municipalities, and local broadcast media at least fourteen days before commencement. For larger operations affecting more than ten acres, or extracting at least twenty-five thousand tons annually, operators must publish notice three times in a local newspaper: the first notice no sooner than 180 days before, the second at least 90 days before, and the third at least 30 days before mining begins, and send all required information, including a map, to the same list of entities at least 90 days before commencement. The required notice must include the operator's identity and address, the mine's location, the type of material to be mined, whether explosives will be used, plans to mitigate dust, stormwater runoff, and noise, the operation's start and end dates, any proposed future land use, and where additional information can be obtained. Additionally, the bill allows the secretary of agriculture and natural resources to waive these notice periods in emergency situations.
