This bill establishes a temporary initiative, running from January 1, 2027, to July 1, 2027, where the Construction Contractors Board will work with the Bureau of Labor and Industries to assess how often unlicensed labor contractors, including those working in construction, are used and present on construction job sites. A "labor contractor" is defined by existing Oregon law (ORS 658.405) as someone who recruits, solicits, supplies, or hires workers to perform labor for others, and a "construction labor contractor" is a specific type of labor contractor involved in construction. The bill allows the Construction Contractors Board, during their regular job site inspections, to look for unlicensed contractors, document potential violations of labor and construction laws, and share this information with the Bureau of Labor and Industries, without creating new penalties. The bill also mandates that by December 31, 2026, the two agencies must plan how to conduct this assessment, including developing strategies for identifying unlicensed contractors and recording observations. They are also permitted to share confidential information between agencies for this initiative and for enforcement purposes, while maintaining the confidentiality of that information. Before the initiative begins, the Construction Contractors Board must notify licensed contractors about the upcoming assessment and the relevant legal requirements. Finally, by October 1, 2027, the agencies will report to the legislature on the initiative's operation and outcomes, offering recommendations for improving enforcement, education, and potentially clarifying laws related to labor contractors. The provisions of this bill will be repealed on January 2, 2028, and the bill takes effect 91 days after the legislative session adjourns.
