This bill amends existing Oregon law (ORS 215.441) to limit a county's ability to regulate the activities that can take place on property designated as a place of worship, such as a church, synagogue, temple, or mosque. Previously, counties could impose reasonable regulations on the physical aspects of these uses, like site or design reviews, or prohibit or restrict their use if public facilities were inadequate. This bill removes the county's ability to impose those physical characteristic regulations and instead allows them to prohibit or restrict use only if the level of public facilities, like transportation or water supply, is inadequate, or if the physical characteristics of the authorized use create a danger to health or safety. The bill clarifies that counties can still allow private or parochial schools for kindergarten through grade 12 or higher education to be located on such properties under existing zoning rules.
