This bill amends West Virginia law to clarify when the Public Service Commission (PSC), the state agency responsible for regulating utility rates and services, can approve increases in utility rates for retail customers. Specifically, the PSC can no longer approve any new rates, charges, or other cost recovery mechanisms unless it can prove, with strong evidence, that the costs passed on to West Virginia consumers are equal to or less than the benefits those consumers will receive. If the PSC does approve such an increase, it must publicly publish a written explanation that quantitatively details its findings and the reasons for its decision.
