Bill Summary

This bill relates to insurance requirements applicable to living organ donors. The bill defines “policy” as a life insurance policy, disability insurance policy, or long-term care insurance policy. A “living organ donor” (donor) is defined as an individual who is not deceased and who has donated all or part of an organ. Under the bill, based solely on an individual’s status as a donor, an insurer shall not: (1) decline or limit coverage under a policy for a covered person that is a donor; (2) as a condition of continued coverage under a policy, preclude a covered person from becoming a living organ donor; or (3) discriminate against a covered person or individual in the offering, issuance, cancellation, coverage amount, price, or any other condition of a policy on the sole basis that the covered person or individual is a donor. The commissioner of insurance shall adopt rules to administer the bill.

AI Summary

This bill establishes protections for living organ donors concerning insurance policies, defining a "policy" as life insurance, disability insurance, or long-term care insurance, and a "living organ donor" as an individual who has donated an organ while alive. Under this legislation, insurance companies are prohibited from denying or limiting coverage, preventing individuals from becoming donors as a condition of continued coverage, or discriminating in policy terms like price or coverage amount solely because someone is a living organ donor. The commissioner of insurance will be responsible for creating rules to implement these provisions.
