This bill, known as the "Second Amendment Reaffirmation and Protection Act," aims to ensure that if federal laws restricting firearms, such as the National Firearms Act (NFA), Gun Control Act (GCA), or Firearm Owners Protection Act (FOPA), are ever repealed, overturned by courts, or otherwise invalidated, West Virginia law will automatically restore full Second Amendment rights without imposing new state-level restrictions. It also prohibits the state and its local governments from creating or enforcing any regulations that mirror or replace these repealed federal laws. The bill reaffirms that all local firearm regulations are subject to state control and prevents counties and municipalities from enacting their own restrictions. Furthermore, it forbids the state legislature or agencies from passing new laws that replicate any federal firearm restrictions that have been removed. Individuals and businesses will be protected from prosecution or penalties for possessing or dealing in firearms or accessories that are no longer federally restricted, and state and local law enforcement are barred from assisting federal agencies in enforcing any repealed or unconstitutional firearm laws, with penalties for violations. Citizens affected by illegal firearm restrictions can sue the responsible officials or agencies and recover damages and attorney fees. The bill declares that the right to bear arms is a natural right and positions West Virginia as a defense against future infringements. Its effective date is triggered immediately upon the official repeal or judicial nullification of any NFA-related provision.
