AI Summary
This bill, titled the "Data Center Development Act," establishes a framework for regulating data centers in South Carolina, aiming to attract investment while protecting existing ratepayers and the environment. It creates a Data Center Development Office within the Department of Environmental Services to act as a central point of contact and manage a permitting process for data centers, which are defined as facilities with a combined electrical load of one megawatt or more. The bill outlines different tiers of data centers (Tier 1: 1-10 MW, Tier 2: 11-50 MW, Tier 3: over 50 MW) with varying permit application requirements and timelines, including infrastructure adequacy assessments and environmental impact reviews. It also sets performance-based operational efficiency and water efficiency standards, requiring annual reports from data center operators. The Public Service Commission retains jurisdiction over electricity rates and agreements between utilities and data centers, with a focus on ensuring data center operators bear their fair share of infrastructure costs. The bill also addresses decommissioning plans and financial assurances for larger data centers, clarifies the interaction with local governments regarding land use, and mandates measures to minimize noise, vibration, and light pollution. Importantly, it protects confidential information shared by data center operators and establishes enforcement mechanisms with penalties that vary by data center tier, while also prioritizing technical assistance for the first two years after enactment to aid industry transition.
