This bill amends existing Idaho law to revise the daily cost, or "per diem," that the state pays to counties for housing state prisoners. Specifically, the bill increases the per diem rate from a maximum of $75 per day per inmate to a flat rate of $80 per day per inmate. This change applies to prisoners convicted and sentenced to the custody of the state board of correction, including probationers and parolees held in county jails. The bill also clarifies that the state board of correction will continue to cover ordinary and necessary medical and dental expenses for these prisoners and that both the state and counties will be responsible for their share of damages or injuries caused by their respective negligence. The bill declares an emergency and sets an effective date of July 1, 2026.
