This bill, concerning the dissolution of marriage in Arizona, introduces a new section to allow couples going through a divorce to create legally binding agreements about the care and possession of their "companion animals," which are defined as domesticated animals commonly known as pets, or animals acquired for security, companionship, or assistance with a disability, and can even include animals used for business or agriculture if not incorporated into the family as pets. These agreements can specify when each person will have the animal and who will be financially responsible for its care. If the couple cannot agree, either party can ask the court to make a decision, and the court will consider factors such as when the animal was acquired, its daily needs, which party typically handles veterinary care, social interaction, compliance with animal laws, and financial ability to care for the animal. Importantly, if the animal is a "service animal," meaning it assists a party or a child with a disability, there's a presumption that custody should go to the party who needs the service animal.
