This bill amends the Election Code to clarify and align existing provisions regarding cybersecurity efforts for election authorities. Specifically, it modifies language that was previously changed by two different Public Acts (P.A. 100-587 and P.A. 100-623) to ensure consistency. The bill mandates that the State Board of Elections adopt rules, following public hearings and consultation with election authorities, to establish a "cyber navigator program." This program is designed to assist election authorities in defending against and recovering from cybersecurity breaches and cyberattacks. The rules will also outline how the Board will allocate funds received under the federal Help America Vote Act, with at least half of these funds dedicated to the cyber navigator program. This program is intended to offer equitable support to all election authorities, with some flexibility for modifications based on specific needs. The remaining funds from the Help America Vote Act can be distributed by the Board as it deems appropriate, but grants will not be provided to election authorities that do not participate in the Board-managed cyber navigator program. The bill also allows for these remaining funds to be used by election authorities for maintaining secure collection sites for vote-by-mail ballots.
