This bill amends the Hospital Licensing Act to modify the definition of "professional judgment" for employed physicians. Previously, situations where an employing entity (like a hospital or its affiliate) did not interfere with a physician's professional judgment included reasonable referral restrictions that, in the physician's judgment, did not negatively impact a patient's health or welfare. This bill removes that specific allowance, meaning that any referral restrictions imposed by an employer will no longer be automatically considered non-interfering if they don't adversely affect the patient, as determined by the physician. The bill takes effect immediately upon becoming law.
