Bill Summary

This act would amend the requirements pursuant to the Hospital Conversions Act to authorize the attorney general and the department of health to permit the filing of an initial application for conversion pursuant to the expedited review provisions of § 23-17.14-12.1 for a hospital subject to court-supervised insolvency proceedings. The provisions of this act shall sunset one year from the effective date of the act, except that the sunset provision shall not inhibit review by either department for any application that was filed on or before the sunset date. This act would take effect upon passage.

AI Summary

This bill amends the Hospital Conversions Act to allow the Attorney General and the Department of Health to permit expedited review for hospital conversion applications when the hospital is undergoing a court-supervised insolvency proceeding, such as bankruptcy. This means that if a hospital is in financial distress and being overseen by a court, the application process for its conversion can potentially be streamlined by using the elements outlined in a specific section (§ 23-17.14-12.1(b)) of the existing law, provided both departments agree this won't hinder their review. The bill also sets a one-year sunset clause for this expedited review provision, meaning it will expire after one year, but any applications filed before that date will still be reviewed. This measure is intended to provide a faster path for hospital conversions in urgent financial situations.
