Bill Summary

Amends the Code of Criminal Procedure of 1963. Provides that when a defendant released pretrial is charged with a felony or Class A misdemeanor that is alleged to have occurred during the defendant's pretrial release, the State may seek revocation of the defendant's pretrial release. Deletes provision that only permits revocation of the defendant's pretrial release if the defendant has previously been granted pretrial release for a felony or Class A misdemeanor rather than any offense and the defendant is charged with a felony or Class A misdemeanor that is alleged to have occurred during the defendant's pretrial release.

AI Summary

This bill modifies the conditions under which a defendant's pretrial release can be revoked. Previously, a defendant's pretrial release could only be revoked if they had already been granted pretrial release for a felony or Class A misdemeanor and were subsequently charged with another felony or Class A misdemeanor that occurred while they were on pretrial release. This bill expands that provision, allowing the State to seek revocation of pretrial release if a defendant is charged with any felony or Class A misdemeanor that allegedly occurred during their pretrial release, regardless of their prior release history for such offenses. The bill also removes a provision that prevented revocation for certain less serious offenses (Class B or C misdemeanors, petty offenses, or ordinance violations) that occurred during pretrial release, though it maintains the possibility of sanctions for such violations.
