Bill Summary

AN ACT To amend Code Section 21-2-417 of the Official Code of Georgia Annotated, relating to presentation of proper identification to poll workers, swearing of statement when unable to produce, use of provisional ballots, and penalty for false swearing, so as to provide that certain driver's licenses and identification cards shall not be proper identification for presentation to a poll worker; to amend Article 2 of Chapter 5 of Title 40 of the Official Code of Georgia Annotated, relating to issuance, expiration, and renewal of licenses, so as to require the term "BEARER NOT A U.S. CITIZEN - NOT VOTER ID" to be included on certain licenses, permits, and special identification cards; to require that certain license, permit, or special identification card numbers be appended with the prefix "NC" to reflect that such cards are held by noncitizens; to provide for duties of the Department of Driver Services; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill amends Georgia law to change what qualifies as proper identification for voting and how certain driver's licenses and identification cards are issued. Specifically, it clarifies that a Georgia driver's license or identification card issued to a noncitizen will no longer be accepted as valid identification when voting, even if it has a photograph. Furthermore, for licenses, permits, or special identification cards issued to noncitizens, the bill mandates that starting August 1, 2027, these cards must clearly state "BEARER NOT A U.S. CITIZEN - NOT VOTER ID" and their identification numbers will begin with the prefix "NC" to indicate they are held by a noncitizen. The Department of Driver Services will also be required to explain the differences between these cards and those issued to citizens on its website.
