This bill amends the "Fair Business Practices Act of 1975" to regulate referral agencies that connect individuals with assisted living communities and personal care homes, which are defined as residences providing housing, food, and personal assistance for adults. Referral agencies, defined as entities that receive a fee from these communities for referrals and are not employees or residents' family members, must provide prospective residents or their representatives with specific disclosures, including any relationships with the communities, the fact that they receive a fee, and that their list of options may not be exhaustive. They must obtain a signed acknowledgment of these disclosures and can only charge fees after a resident confirms in writing they used the agency's services to move, and only if the move occurs within 12 months of the referral. Furthermore, referral agencies are required to verify that any assisted living community or personal care home they refer to is properly licensed by the Department of Community Health.
