This bill amends West Virginia law to impose a life sentence on individuals convicted of manufacturing, delivering, or possessing with intent to manufacture or deliver a controlled substance classified as Schedule I or II, specifically when that substance is fentanyl, either alone or mixed with other substances. Previously, such offenses carried a potential prison sentence of three to fifteen years and a fine of up to $50,000. The bill also makes it a felony, punishable by life imprisonment, to adulterate another controlled substance with fentanyl, create a counterfeit or imitation controlled substance using fentanyl, or cause such adulteration or counterfeiting.
