This bill, titled the "Highway Alternative Project Delivery Program," authorizes the West Virginia Division of Highways to use an alternative contracting procedure called "general contractor/construction manager" for projects, which combines design and construction into a single contract. This new procedure, outlined in section 17-2D-6, allows the Commissioner of Highways to enter into agreements following federal guidelines (23 U.S.C. 112 and 23 CFR §635 Subpart E) and is distinct from traditional design-build bid requirements. The bill also revises existing provisions related to the Highway Design-Build Program, expanding the types of projects that can be combined (including buildings and grounds) and adjusting the financial limits for contractual obligations on projects, with different caps for projects financed with or without bonds and for those exceeding federal core funding or necessitated by a declared state of emergency. The Commissioner is empowered to create procedural rules for implementing these alternative contracting methods.
