Bill Summary

AN ACT concerning public assistance; requiring the secretary for children and families and the secretary of health and environment to execute a memorandum of understanding, data use agreement or other written data-sharing instrument upon written request of the United States department of agriculture or the United States department of health and human services; requiring such secretaries to comply with written data requests from such federal agencies made pursuant to such memorandum of understanding, data use agreement or written data- sharing instrument; amending K.S.A. 39-760 and repealing the existing section.

AI Summary

This bill requires the Secretary for Children and Families and the Secretary of Health and Environment to enter into formal agreements, such as a memorandum of understanding (MOU) or data use agreement, when requested in writing by the U.S. Department of Agriculture (USDA) or the U.S. Department of Health and Human Services (HHS). These agreements will facilitate the exchange of information. Once an agreement is in place, the respective Kansas secretaries must comply with written data requests from these federal agencies, providing the requested data within 30 days. The bill also makes conforming changes to existing law regarding reporting suspected abuse or fraud in public assistance programs and repeals the old version of that law.
