This bill amends West Virginia law to clarify the grounds upon which the West Virginia Real Estate Commission (WVREC) can refuse, suspend, or revoke a real estate license, with a specific focus on the operation of real estate "teams." The WVREC can take disciplinary action for a wide range of offenses, including submitting false information on applications, making substantial misrepresentations or false promises, commingling client funds with personal funds, engaging in misleading advertising, acting for multiple parties without consent, failing to account for client money, and violating anti-discrimination laws. The bill also adds a provision that prohibits licensees from leading a real estate team outside the direct supervision of their broker of record or implying they have independent broker authority without the proper license. However, it clarifies that a salesperson can lead a team if it operates under a single supervising broker who retains full responsibility, and no team member misrepresents their licensing status. Additionally, team leads must register with the WVREC annually and complete three additional hours of specialized education each year.
