This bill establishes new rules for law enforcement officers in Idaho regarding the wearing of facial coverings, which are defined as anything that conceals or obscures an individual's facial identity, such as a balaclava or ski mask, but specifically excludes items like clear face shields, N95 masks for health protection, or equipment for underwater use. Generally, law enforcement officers are prohibited from wearing such facial coverings while performing their duties, with several exceptions, including active undercover operations, tactical operations requiring protective gear, occupational health and safety needs, protecting identity during prosecution, SWAT team duties, and reasonable accommodations. A knowing violation of these provisions can result in an infraction or misdemeanor, and officers who commit certain offenses like assault or false arrest while in violation of this law will not be able to claim immunity and will be liable for damages, including a minimum of $10,000 in statutory damages. The bill also declares an emergency and sets an effective date of July 1, 2026.
