Bill Summary

AN ACT IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend, on an emergency basis, the Universal Paid Leave Amendment Act of 2016 to prohibit private disability insurance providers from reducing short-term disability benefits based on actual or estimated paid leave benefits to which an eligible individual may be entitled to from the District, regardless of the jurisdiction in which the insurance policy was issued or written; and to amend the Insurance Trade and Economic Development Amendment Act of 2000 to make the prohibition on offsetting or reducing benefits under a private market short-term disability insurance policy based on estimated or actual benefits received under the Universal Paid Leave Amendment Act of 2016 enforceable under that law, regardless of the jurisdiction in which the insurance policy was issued or written.

AI Summary

This bill, the Short-Term Disability Insurance Benefit Protection Clarification Emergency Amendment Act of 2026, aims to prevent private insurance companies from reducing short-term disability benefits for individuals who are also receiving paid leave benefits from the District. Specifically, it amends the Universal Paid Leave Amendment Act of 2016 and the Insurance Trade and Economic Development Amendment Act of 2000 to ensure that private disability insurance providers cannot offset or decrease benefits based on actual or estimated paid leave payments received under the District's Universal Paid Leave program. This prohibition applies regardless of where the private insurance policy was issued or written, making it enforceable under District law. The term "eligible individual" refers to someone who qualifies for benefits under the Universal Paid Leave Act. This emergency measure is intended to be in effect for a limited period of 90 days.
