This bill mandates that within one year before the closing of any residential real estate transaction, a radon test must be conducted, with the seller responsible for the cost of this test. Radon is a naturally occurring radioactive gas that can be harmful to health. If the test reveals unsafe radon levels, defined as exceeding the Environmental Protection Agency's action level of 4.0 picocuries per liter (pCi/L), the seller must then pay for and install a radon mitigation system, which is a system designed to reduce radon concentration in a building, before the sale can be finalized. The bill also specifies certain types of property transfers, such as those by lenders after foreclosure or transfers for demolition, that are exempt from these requirements, and clarifies that the buyer can opt to conduct their own independent radon test at their own expense.
