This bill, titled the Citizens' Data Center Transparency Act, prohibits data centers in West Virginia from being used for unconstitutional surveillance by federal agencies like the National Security Agency (NSA) or any other entity, ensuring that personal information, communications, and data are not collected without a warrant, which would violate the Fourth Amendment of the U.S. Constitution and Article III, Section 6 of the West Virginia Constitution. The state is also forbidden from assisting any federal agency or contractor involved in such surveillance, and data center operators cannot knowingly participate in or aid these activities. Furthermore, data center operators must annually report to the Joint Standing Committee on Technology and Infrastructure about the types and amounts of data collected, how it's used, and a list of all entities, including government agencies and non-governmental organizations, that use their facilities, allowing the committee to review and assess data center practices to protect citizens' rights and investigate any emerging concerns.
