This resolution declares an emergency to correct an error in the Strengthening Traffic Enforcement, Education, and Responsibility (“STEER”) Amendment Act of 2024, which established an Intelligent Speed Assistance Program (ISAP) and modernized the Ignition Interlock Device Program. The ISAP, administered by the Department of Motor Vehicles (DMV), requires drivers convicted of certain offenses to use intelligent speed assistance systems as a condition for reinstating their licenses. The STEER Act also amended existing laws regarding license suspension and reinstatement. While the ISAP was funded in Fiscal Year 2024, the modernization of the Ignition Interlock Device Program was funded in Fiscal Year 2026, with actual implementation funding not available until Fiscal Year 2027. A recent budget act mistakenly made certain provisions of the STEER Act, particularly those related to the Ignition Interlock Device Program, subject to appropriations, which has caused the DMV to pause the launch of the ISAP because the underlying provisions are considered unfunded. This emergency resolution aims to clarify that the STEER Act's provisions are indeed funded for ISAP implementation, allowing the program to proceed.
