This bill mandates that "covered providers," defined as entities creating or operating generative artificial intelligence (AI) systems with over one million monthly users that are publicly accessible in Arizona for personal use, must embed "provenance data" into any video, image, or audio content materially altered or created by their AI systems and shared with users. Provenance data is information embedded in digital content or its metadata to verify its authenticity, origin, or modification history, using generally accepted security practices. Covered providers must use commercially and technically reasonable methods to make this data difficult to remove or tamper with, with watermarking and metadata being acceptable methods. The bill clarifies that minor alterations, such as adjusting brightness, color, or resizing, do not constitute material alterations. It also states that covered providers generally cannot include personal information in provenance data unless a user affirmatively chooses to do so. Exceptions to these requirements include certain video games, non-user-generated streaming content, virtual shopping applications, cloud service providers, business-to-business AI systems, and accessibility tools for individuals with disabilities, provided reasonable measures are taken to prevent misuse. The bill also prohibits requiring disclosure of trade secrets related to AI systems. The legislature intends this act to broadly protect individuals from AI risks, promote transparency, provide notice of AI use, and prevent fraud or deception, with an effective date of February 1, 2027.
