This bill amends existing Arizona law regarding Empowerment Scholarship Accounts (ESAs), which are state-funded accounts that provide parents with options for their children's education. The key provisions of this bill clarify and expand the requirements for parents and qualified schools participating in the ESA program, particularly for children with disabilities. Specifically, it mandates that qualified schools must inform parents in writing about the individual special education services and educational therapies they will provide to students with disabilities before enrollment, though this notification is not required for subsequent years at the same school. Furthermore, qualified schools must provide all accommodations and services outlined in a student's individualized education program (IEP) or Section 504 plan, unless the parent or student waives these in writing. If a school fails to provide these services or obtain a waiver, the student can transfer and is entitled to a refund for unused tuition. The bill also clarifies that ESA funds cannot be shared, refunded, or rebated with parents or students, and it adds provisions for the closure of accounts if not renewed for three consecutive academic years.
