This concurrent resolution proposes an amendment to the Arizona Constitution that would allow individuals sentenced to death to choose their method of execution from a firing squad, lethal injection, or lethal gas. If the defendant does not make a choice, lethal injection will be the default method. However, for defendants who have murdered a law enforcement officer, death by firing squad is mandated if the defendant knew or should have known the officer was on duty. The resolution also specifies that a firing squad execution would involve at least three volunteer shooters and the use of one blank round, and that executions must occur within the state prison. If any chosen method becomes unavailable or is invalidated by a court, the defendant can select another available option, and if all choices are unavailable, the death sentence will be carried out by any lawful means. This proposed amendment will be put to a vote of the people at the next general election.
