This bill amends the Illinois Pesticide Act to restrict the use of pesticides containing neonicotinoids on ornamental plants, which are defined as plants grown for aesthetic reasons, starting July 1, 2027. The restrictions will not apply if the pesticide is used outdoors for structural pest control or to manage invasive insect pests like the Emerald Ash Borer, provided the application is limited to specific methods such as basal bark spray, soil injection at the base of a tree, or trunk injection, and does not involve broadcast soil treatment, foliar spraying, or dusting. If applied to plants pollinated by insects, birds, or bats (known as zoophilous species), the application must occur after blooming has finished and be done early enough for the chemical to break down before the next blooming season. The bill also clarifies that a "restricted use pesticide" now includes any pesticide containing a neonicotinoid, unless it's applied by a licensed applicator or certified technician for structural pest control. The Department of Agriculture, Department of Public Health, and Environmental Protection Agency are granted the power to create rules to implement these changes.
