Bill Summary

AN ACT To amend and reenact R.S. 14:202.1(A)(introductory paragraph), (2), (3), and (6), (B), (C)(1), and (D), relative to the crime of contractor fraud; to provide for the types of property to which the crime applies; and to provide for related matters.

AI Summary

This bill expands the definition of contractor fraud to apply to any "building" improvements, not just those on residential property, and broadens the scope of what constitutes contractor fraud to include using deception to get someone to sign a contract, damaging property to force a contract, and failing to have the required license for building improvements. It also clarifies that restitution for contractor fraud victims includes the cost of repairing faulty work and completing unfinished work, and adds a provision for enhanced penalties, including up to five additional years in prison, if the victim is sixty-five years or older and the property involved is residential.
