Bill Summary
AN ACT To amend Part 2 of Article 4 of Chapter 11 of Title 16 of the Official Code of Georgia Annotated, relating to possession of dangerous weapons, so as to provide for the offense of unlawful possession of parts of a machine gun; to provide for punishment; to provide for an exemption; to revise and provide for definitions; to provide for related matters; to repeal conflicting laws; and for other purposes.
AI Summary
This bill amends Georgia law to create the new offense of unlawful possession of parts of a machine gun, defining "parts of a machine gun" to include the frame or receiver, parts used to convert a pistol into a machine gun, or any combination of parts from which a machine gun can be assembled if under a person's control. The bill also clarifies the definition of a "machine gun" to include weapons that can be readily converted to shoot automatically more than one shot without manual reloading by a single trigger pull. Possession is broadly defined to include actual or constructive custody or control, such as manufacturing, obtaining, receiving, selling, or using these parts. Conviction for this new offense carries a penalty of one to five years in prison. An exemption is provided for manufacturers licensed under federal law, specifically the Gun Control Act of 1968 and the National Firearms Act, who are acting in accordance with those provisions.
