This bill allows certain manufacturers of zero-emission motor vehicles to operate as new car dealers in West Virginia, even if it contradicts other existing laws. To qualify, a manufacturer must have been producing zero-emission vehicles since at least 2008, exclusively manufacture or assemble zero-emission vehicles, and have never sold their vehicles in West Virginia through a franchised dealer. Additionally, the manufacturer cannot have gained control of a franchisor (a company that grants franchises, like a car company selling to dealerships) or a related entity, nor can they have sold or transferred control of themselves to a franchisor or related entity. This provision aims to enable manufacturers of innovative, environmentally friendly vehicles to sell directly to consumers in the state.
