This bill amends West Virginia law to allow for the sale and distribution of "vintage distilled spirits," which are defined as unopened, original manufacturer's containers of distilled spirits that are not owned by a distillery and are not otherwise available for purchase from a licensed wholesaler in the state. Specifically, it permits individuals or businesses licensed to sell distilled spirits to purchase these vintage spirits from non-licensed individuals, provided they notify the Alcohol Beverage Control Commission (the state agency that regulates alcohol sales). The bill further clarifies that vintage distilled spirits can be resold either by the drink by establishments licensed to sell spirits for on-premises consumption, or by the package by those licensed to sell spirits for off-premises consumption. Additionally, it allows distillers to sell alcoholic beverages by the drink at events like fairs and festivals, as long as the beverages contain spirits distilled or bottled on their premises.
