This bill amends existing Idaho law to establish an Idaho residency requirement for individuals seeking to receive funds from the Idaho Consumer Asset Recovery Fund (ICAR). The ICAR is a fund designed to compensate consumers who suffer actual losses or damages due to fraud or violations by licensed motor vehicle dealers. Under the proposed changes, only an Idaho resident, or someone who was an Idaho resident at the time they purchased or leased a motor vehicle, can file a claim against the fund for losses incurred on or after July 1, 2014. The bill also clarifies that claims must be filed within a specific timeframe after a final judgment is awarded and reiterates that motor vehicle dealers, financial institutions, and entities providing floor plans for dealers are not eligible to receive payments from the fund. Finally, the bill declares an emergency and sets an effective date of July 1, 2026.
