This bill authorizes the Kansas Department of Transportation (KDOT), led by its Secretary, to establish and manage a statewide fiber optic conduit system, which is a physical infrastructure of pipes and micro-ducts designed to house optical fibers for broadband internet connections. KDOT can enter into agreements with other government and private entities to use this system, requiring them to obtain permits and pay fees sufficient to cover KDOT's costs. These fees, along with legislative appropriations and other contributions, will go into a newly created "Kansas Broadband Revolving Fund," which will be used to fund the system's planning, construction, maintenance, and administrative costs. While the bill initially allowed for revenue bonds to finance the system, this provision has been removed, and the focus is now on the revolving fund. Importantly, no entity is forced to use KDOT's system; they can still build their own within state highway rights-of-way. Finally, the Secretary of Transportation is required to submit an annual report to the legislature detailing the system's progress, costs, agreements, and future plans.
