This bill amends Idaho Code Section 74-105 to add a new provision exempting photographs or images of a decedent taken during a coroner's death investigation or a law enforcement investigation from public disclosure, regardless of whether the investigation is ongoing. However, these photographs or images can be released to the decedent's "next of kin" – defined as the closest living relative in the order of spouse, adult children, parents, siblings, and grandparents – once the death investigation, any related criminal case, and all appeals and civil proceedings stemming from that criminal case are no longer active. This change aims to protect the privacy of the deceased and their families during sensitive investigations while eventually allowing for disclosure to immediate family members.
