This bill amends an existing South Dakota law, specifically section 41-11-7, to allow for the salvage of certain bird eggs under specific conditions. Previously, it was generally illegal to take, possess, or destroy bird nests or eggs, with violations considered a Class 2 misdemeanor, which is a minor criminal offense. However, this bill introduces an exception, permitting egg salvage if two conditions are met: first, the individual must possess a migratory bird special purpose salvage permit issued by the United States Fish and Wildlife Service, following federal regulations outlined in 50 C.F.R. § 21.95 (as of January 1, 2026); and second, the salvage activity must not involve the eggs of birds that are protected from being taken or killed at all times.
