AN ACT concerning energy; enacting the private energy campus and industrial host site generation act; authorizing the sales of electricity and the provision of ancillary services to private industrial and data center enterprises located on a private energy campus; exempting such sales and services from public utility regulation; authorizing an electric public utility to enter into interconnection and energy services agreements with a private energy campus; exempting a private energy campus from parallel generation and net metering requirements; defining a private energy campus; amending K.S.A. 66-1,170 and K.S.A. 2025 Supp. 66-104, 66-1,184 and 66-1264 and repealing the existing sections. WHEREAS, The state of Kansas is experiencing an increasing demand for firm, dispatchable electric power driven by emerging and expanding industrial sectors, including, but not limited to, hydrogen production, ammonia synthesis, data center operations and advanced manufacturing; and WHEREAS, Regulated electric public utilities have publicly identified a growing deficit in dispatchable generation capacity necessary to reliably meet current and projected load demand forecasts; and WHEREAS, Preserving the exclusive service territories of electric public utilities is essential to maintaining reliable and affordable electric service for residential and small commercial ratepayers; and WHEREAS, Allowing voluntary, negotiated arrangements between a private energy campus and electric public utilities for emergency support, standby service, energy exports and grid reliability enhances the resilience of the electric system and benefits all electric customers. AI Summary

This bill, known as the Private Energy Campus and Industrial Host-Site Generation Act, establishes a framework for private energy campuses to generate and sell electricity and provide related services exclusively to industrial and data center enterprises located within their boundaries, exempting these transactions from traditional public utility regulation. It allows electric public utilities, which are companies that provide electricity to the public, to enter into agreements with these private energy campuses for services like standby or emergency power and to accept energy exported from the campus to the utility's grid. The bill defines a "private energy campus" as a contiguous site owned by a single entity, developed to serve the energy needs of on-site industrial or data center enterprises, and not intended for general public retail electric service. Importantly, it clarifies that these private energy campus operations are not considered "public utilities" or "retail electric suppliers" under existing laws, nor are they subject to parallel generation or net metering requirements, which are regulations typically governing smaller-scale renewable energy systems connected to the grid. The legislation aims to encourage private investment in energy generation to meet the growing demand from large industrial users while preserving the existing service territories and regulatory oversight of public utilities for other customers.
