Bill Summary
AN ACT to amend the executive law, the correction law and the civil rights law, in relation to immigration enforcement; and providing for the repeal of such provisions upon expiration thereof
AI Summary
This bill aims to regulate the coordination between state and local law enforcement agencies and the federal government regarding immigration enforcement, the release of incarcerated individuals for federal immigration purposes, and immigration enforcement in sensitive locations. Specifically, it prohibits state and local law enforcement agencies from entering into agreements with the federal government for civil immigration enforcement, except to notify federal officials about incarcerated noncitizens and to facilitate the transfer of removable noncitizens who are in the custody of the state department of corrections and community supervision or local correctional facilities; however, it allows for coordination with federal officials for security at ports of entry, along the Canada-United States border, or for assisting with judicial warrants or investigations of criminal law violations. The bill also stipulates that a local correctional facility can only release a deportable noncitizen who is in their custody and facing felony charges to immigration officials with the consent of the district attorney or appropriate prosecuting agency, though this restriction does not apply if the noncitizen has completed their sentence. Furthermore, it defines "sensitive locations" to include schools, facilities serving children, healthcare facilities, and houses of worship, and prohibits civil immigration enforcement actions in these locations unless a valid judicial warrant from a federal court is presented. The bill also provides for legal recourse for violations of these provisions and will expire and be repealed one year after its effective date.
