This bill amends Tennessee Code Annotated, Section 29-39-102, to establish a cap on certain damages in specific medical malpractice cases. Specifically, in a health care liability action, which refers to a lawsuit for damages related to medical services, that arises from negligence during obstetric or maternity care and results in the death or permanent injury of a pregnant or postpartum woman, the amount awarded for noneconomic damages, which are damages for non-monetary losses like pain and suffering, cannot exceed $1 million.
