Bill Summary

As enacted, authorizes, during a state of emergency that is based on a natural emergency, an emergency utility worker to travel upon public roads and enter areas subject to curfew or restricted access orders when such access is necessary to perform emergency utilities restoration activities; provides that an emergency utility worker, and the emergency utility worker's employer, are immune from civil liability for injury, death, or property damage resulting from an act or omission of the emergency utility worker committed in good faith while engaged in emergency utilities restoration activities during a state of emergency declared that is based on a natural emergency. - Amends TCA Title 4; Title 29; Title 39 and Title 58.

AI Summary

This bill defines "emergency utility worker" as someone employed by or contracted by a utility company to restore essential services like electricity or gas during a declared natural emergency, and grants these workers the ability to travel and enter restricted areas for restoration work, provided they show credentials to law enforcement, though this access can be denied for valid law enforcement reasons. It also expands the definition of "first responder" to include these emergency utility workers when considering certain legal protections, and provides immunity from civil liability for these workers and their employers for good-faith actions during emergency restoration, excluding cases of willful misconduct or gross negligence, and clarifies that this immunity does not apply to employers for their own negligence or that of their employees in certain situations.
